In consideration of being allowed to participate in any way, in the many “Activities” (including but not limited to Year Premier, Marmathon, Homecoming Bonfire building, after-school formations, competitions, dances, field trips, parades, performances and retreats) during the Marmion Academy 2025-2026 school year, I, the undersigned, acknowledge, appreciate and agree that:
1. The risk of injury from the Activities is significant including, but not limited to the following: (i) sprains; (ii) strains; (iii) fractures; (iv) heat and cold injuries; (v) over-use syndrome; (vi) injuries involving vehicles; (vii) animal bites and/or stings; (viii) contact with poisonous plants; (ix) accidents involving, but not limited to climbing, falls, running, hiking, crawling, walking, traveling, if not located on Marmion campus, by bus, truck, car, or other conveyance whether or not owned by Marmion; (x) the potential for cuts, scrapes and bruises; (xi) contact with other participants; (xii) negligent or wanton acts of other participants; (xiii) defects or condition of premises; (xiv) effects of the weather; and (x) illness or infections. While particular rules, equipment, and personal discipline may reduce this risk, the risks of serious injury and death do exist;
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation;
3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual and/or significant hazard during my presence or participation, I will remove myself from participation and bring such hazard to the attention of the nearest employee or volunteer;
4. I, for myself and on behalf of my heirs, assigns, personal representatives and/or next of kin, forever WAIVE, RELEASE, DISCHARGE and COVENANT NOT TO SUE Marmion, Inc., Marmion Abbey, Marmion Academy, Abbey Farms (collectively referred to as “Marmion”) and their officers, directors, representatives, officials, agents and/or employees, subsidiaries, and/or assigns, as well as their independent contractors, sponsoring agencies, sponsors, advertisers, volunteers, and if applicable, owners and lessors of the premises used to conduct the Activities (collectively, the "Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, and/or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE. I further agree to indemnify, defend and hold harmless Releasees from any loss, liability, cost, claim or damages (including the payment by me to Releasees for any and all reasonable attorneys’ fees and expenses) arising from my participation in or association with Activities and events organized and sponsored by Marmion;
5. I attest and verify that I am free from all illnesses, injuries and defects and that I am physically fit and sufficiently trained to participate in all Activities. My participation in Activities organized or sponsored by Marmion is entirely voluntary. If I am disabled in any way or have recently suffered an illness or injury, I should have consulted or did consult a physician before participating in the Activities;
6. I consent to administration of first aid and other medical treatment in the event of injury or illness and hereby release and indemnify Releasees from any and all liability or claims arising out of such treatment;
7. I understand and agree that Releasees may not be able to provide medical personnel and that the medical personnel may not always be available at the Activities. I hereby give my consent to have Marmion representatives, athletic trainer, a fellow participant, an adult supervisor, emergency medical personnel, and/or a doctor of medicine or dentistry or associated personnel to provide me (or my child/ward) with medical assistance and/or treatment, and I agree to be financially responsible for the cost of such assistance and/or treatment. I also agree to save and hold harmless and indemnify Releasees from all liability, loss, cost, claim, lawsuit, or damage, whatsoever, including injury, death, or property damage, which may be imposed upon Releasees because of any defect in or lack of such capacity to so act or caused or alleged to be caused in whole or in part by the negligence of the released parties;
8. The Releasees reserve the right, in their sole determination, to postpone, cancel, or modify the Activities due to weather conditions or other factors beyond the control of the Releasees that might affect the health and/or safety of the participants;
9. Participants are expected to exhibit appropriate behavior at all times, including obeying all laws. This includes respect for all people, equipment, and facilities, and cooperative, positive participation. Marmion Academy may dismiss anyone whose behavior negatively endangers safety or negatively affects a race, a person, a facility, or property of any type or kind. I also agree to indemnify Releasees, their affiliates and assigns, from any and all third party claims caused in whole or in part by my actions;
10. I agree to observe and obey all posted rules and warnings, to follow any instructions or directions given by Releasees through their employees, volunteers, representatives or agents, and to abide by any decision of any Activities official relative to my ability to safely compete in the Activities.
11. I grant full permission to Releasees, as described above, to use photographs, images, videotapes, motion pictures, recordings, or any other record of the Activities for any legitimate purpose in perpetuity, and I understand that I shall not be entitled to any compensation therefore; and
12. I hereby grant permission gratis to the Releasees to film, videotape and record gratis the performance of the above named participant (referred to herein as “I”, “me”, “my”) as it relates to the Activities and subsequently to telecast and otherwise utilize the same gratis in whatever manner Releasees shall deem appropriate. Such permission shall include the unlimited right to appropriate use gratis by Releasees of my name, nickname, image, likeness, voice, photograph, signature facsimile and biographical information in connection with the Activities. I acknowledge that Releasees and their representatives shall have the unlimited right throughout the universe to copyright, use, reuse, publish, republish, broadcast and otherwise distribute all or any portion of the Activities in which I may appear on any and all radio, network, cable and local television programs and in any print materials and in any other format or media (including electronic media) now known or hereinafter devised in perpetuity without compensation. In consideration and in return for being allowed to participate in the Activities, I release and agree not to sue the Releasees from all present and future claims regarding my participation in the Activities that may be made by me, my family, estate heirs, or assigns, and further to indemnify, defend and hold harmless Releasees from any loss, liability, cost, claim or damages (including the payment by me to Releasees for any and all reasonable attorneys’ fees and expenses) arising from my participation in or association with Activities and events organized and sponsored by Marmion or connected with the Activities.
